The split decision overturned a previous court ruling and has temporarily denied attempts by tribes and environmental groups to stop Arizona Snowbowl Ski Resort from expanding development and making fake snow from treated sewage effluent on the holy mountain.&lt;br /&gt;&lt;br /&gt;"The cultural survival of more than 13 Indigenous Nations is directly intertwined with the environmental integrity of the holy San Francisco Peaks," said Jeneda Benally, a volunteer with the Save the Peaks Coalition. "Today's decision not only places these ways of life in peril but sets the stage for an ecological and public health catastrophe. We have no choice but to uphold our commitment to protect the holy San Francisco Peaks," continued Benally.&lt;br /&gt;&lt;br /&gt;The United States Forest Service manages the San Francisco Peaks as public land and has faced multiple lawsuits by the Navajo Nation, Hopi, White Mountain Apache, Yavapai Apache, Hualapai, and Havasupai tribes, as well as the Sierra Club, Flagstaff Activist Network, Center of Biological Diversity, and others after it initially approved the proposed ski area development in 2005.&lt;br /&gt;&lt;br /&gt;In the most recent ruling, the Court found that using reclaimed sewer water to make snow for skiing on an admittedly sacred site posed no 'substantial burden' on the Plaintiffs' exercise of religion in this case.  According to the Court, the "only effect of the proposed upgrades is on the Plaintiffs' subjective, emotional religious experience.  That is, the presence of recycled wastewater on the Peaks is offensive to the Plaintiffs' religious sensibilities…the diminishment of spiritual fulfillment – serious though it may be – is not a 'substantial burden' on the free exercise of religion." The Court dismissed Plaintiffs' religious beliefs as calling them mere "damaged spiritual feelings."   &lt;br /&gt;&lt;br /&gt;Tribes' primary arguments focused on religious issues by utilizing the Religious Freedom Restoration Act (RFRA), which they had hoped would provide the necessary legal protection where other laws such as the American Religious Freedom Act have failed.&lt;br /&gt;&lt;br /&gt;"The opinion is unfortunate and, in my opinion wrong," stated Howard Shanker, who represents Navajo Nation, Havasupai Tribe, White Mountain Apache Nation, Yavapai-Apache Nation, Sierra Club, Center for Biological Diversity, and the Flagstaff Activist Network. "The Court places itself in the position of judging the legitimacy of Native American beliefs and practices. It becomes the arbiter of religion which is not the proper role for the courts. The evidence clearly shows that the Peaks are important to 13 of the Tribes in the southwestern United States and that using sewer water to make snow on them constitutes a significant burden on the Tribe's ability to practice their religion."&lt;br /&gt;&lt;br /&gt;"In this country Native Americans have no First Amendment rights when it comes to government land use decisions," stated Howard Shanker, who is also running for Congress in Arizona’s Congressional District 1. "The federal government likely holds thousands of acres of land that Tribes hold sacred. This case was the last, best chance for the Tribes to be able to provide some legal protection to those lands. In a nation that prides itself on religious liberty, it is unconscionable that Native American beliefs are not respected under the law or the Constitution. We anticipate petitioning the U.S. Supreme Court for review of this matter," said Shanker.&lt;br /&gt;&lt;br /&gt;"This ruling sets a negative precedent that impacts the future of Native American religious practice,” said Francis Tso of the Save the Peaks Coalition. “We will seek to reverse this appalling decision."&lt;br /&gt;&lt;br /&gt;The three dissenting Judges from the en banc Court argued that, "Religious exercise, invariably, and centrally, involves a 'subjective' spiritual experience." The dissenting judges further provided that, "The majority's misunderstanding of the nature of religious beliefs and exercise as merely "subjective" is an excuse for refusing to accept the Indians' religion as worthy of protection under RFRA." As noted by the dissent, "RFRA was passed to protect the exercise of all religions, including the religions of American Indians. If Indians' land-based exercise of religion is not protected by RFRA in this case, I cannot imagine a case in which it will be. I am truly sorry that the majority has effectively read American Indians out of RFRA."&lt;br /&gt;&lt;br /&gt;"This decision is a painful affirmation of the lack of protection for our religious freedom," said Alberta Nells with the Youth of the Peaks. Nells continued, "It is a bitter reminder that not all citizens are equal in this country, but just as the civil rights movement did not give up when courts delivered blow after blow, we will not give up until our rights are fully upheld. We, the youth, will continue to stand up for our cultural survival."&lt;br /&gt;&lt;br /&gt;“Federal land management policies are inconsistent when addressing Native American religious practice relating to sacred places. This case underscores the fact that we need legislative action to guarantee protection for places held holy by Native American tribes”, stated Klee Benally of the Save the Peaks Coalition. “The deeply held religious beliefs of hundreds of thousands of citizens of this country have been trumped by a single for profit private business operating on public lands. What I keep wondering is ‘How is that considered justice?’” continued Benally.&lt;br /&gt;&lt;br /&gt;Environmental groups argued that the Forest Service violated the National Environmental Policy Act. "Eight of eleven judges decided to completely ignore the issue of 'What happens if a child were to eat this snow?'" said Rudy Preston of the Flagstaff Activist Network and a plaintiff in the case. Preston continued saying that, "The court dismissed the whole health issue on a procedural error thereby refusing to comment on the true health impacts of this fake snow, which has been proven to contain harmful pharmaceuticals and personal care productions, on our children. The court has obviously cast off this responsibility, and we will continue to demand accountability for our children and the land."&lt;br /&gt;&lt;br /&gt;Environmental groups are concerned with the health hazards of using treated sewage effluent to make this snow, and are committed to continuing to challenge this ruling. “We obviously disagree with ruling—snowmaking with sewage is still plainly a bad idea,” said Taylor McKinnon, Public Lands Director with the Center for Biological Diversity, “We’ll keep fighting along side our partners. This study included 320,890 men age 18 and older in the general population, 104,026 of them veterans, whom researchers followed for 12 years. Veterans who were white, had at least 12 years of education, or whose daily-life activities were limited by health problems were at highest risk. Those who were overweight had a lower risk. By the end of the study, 197 of the veterans had died by suicide. Compared to civilian men who died by suicide, veterans were 58 percent more likely to use a firearm to end their lives. The researchers also note that the number of veterans with daily-life activity limitations – one of the higher risk factors for suicide listed above – is likely to rise. Members of the Save the Peaks Coalition, Tribal leaders, environmental advocates, and concerned members of the community gathered at the foothills of the sacred mountain to voice their concerns and announce appeals to the decision at a news conference.&lt;br /&gt;&lt;br /&gt;“The federal government felt, and the court affirmed, that the economic viability of the Arizona Snowbowl Resorts Limited Partnership was more of a priority than the beliefs of hundreds of thousands of Native Americans.” Said lawyer Howard Shaker who represented the Navajo Nation, Yavipai Apache, white Mt. Apache, The center for Bio logical Diversity, Sierra Club, Flagstaff Activist Network , in a written statement. “This decision will be appealed.”Leigh Kuwanwisiwma, director for the Hopi Tribe’s Cultural Preservation Office stated, “I want to express disappointment. The decision doesn’t surprise me at all, it’s a part of the legacy of insensitivity by federal agencies such as the Coconino National Forest Service on the civil and human rights of many people including the Hopi People.” Kuwanwisiwma said, “The tribe will consider an immediate call for an injunction in addition to an appeal.”&lt;br /&gt;&lt;br /&gt;Jamie Fullmer, the Tribal Chairman of The Yavapai-Apache Nation and Vincent Randall a Tribal Council Historian released a joint statement expressing their disappointment to this “dangerous precedent”. “Recent history has shown the federal courts are not supportive of Native American sensibilities and traditions when it comes to issues concerning the landscape and spiritual health of our People. This decision to move ahead with fake snow may see some short term success, but the long term consequences and repercussions could over time haunt all of us, regardless of which culture you claim as your own.”&lt;br /&gt;&lt;br /&gt;“This is a devastating tragedy for all those who value environmental health, culture and religious freedom.” said Klee Benally, Navajo of the Save the Peaks Coalition, “This is a miscarriage of justice. This is a defeat for those who have faith that the justice system is unbiased and indiscriminate, and all of us, native or not, will pay the price.”“The District Court’s decision to allow Snowbowl expansion and snowmaking with wastewater is yet another link in an ever-growing chain that shackles the environment and the people who value it.” Said Carly Long of the Flagstaff Activist Network, a litigant in the case. “There is still an opportunity for justice to be served at the 9th Circuit level in San Francisco and we will appeal the District Court’s ruling in this case.” Carly Long said, “We will persist in our endeavor to ensure that the spiritual integrity of all people whom hold this mountain sacred is upheld and unbroken.”"This is not the end, we have to continue to go forward in a peaceful way, until we let the mountain know that we’re not going to give up." Said Bucky Preston, a Hopi litigant, in a written statement.Coconino High School student Alberta Nells, Navajo, of the Youth of the Peaks stated, “We all realize the sacredness of this mountain, we are all upset by the decision. This is really important for us as the youth, we do this for the generations that are coming, so then they will remember who they are by looking at this mountain, to know what their responsibilities are as indigenous peoples.”&lt;br /&gt;&lt;br /&gt;Kelvin Long Executive Director of ECHOES said, “The Judges decision was only made at the Federal District level, and is part of a historically crucial case that is predicted to head to the Supreme Court. This is a tragedy to humanity, we as indigenous peoples have been murdered by the millions since contact with the European settlers, we have had our lands, languages, traditions, for the most part wiped out, but there are still some of us who are here, and we will continue to be here, unfortunately our existence is not without great struggle for survival and respect."ECHOES along with the Save The Peaks Coalition are organizing a campaign to stop the City of Flagstaff’s wastewater sale to the Arizona Snowbowl.Howard Shanker also stated, “No other ski area in the Country, or even the world that we are aware of, uses 100% treated waste sewage to make snow. Posting signs throughout the ski area saying "don't eat the snow" is not an adequate safeguard to protect against the known and unknown risks of exposure to the types of chemicals that persist in this effluent. The potential impacts on children especially, many of whom may be too young to read the signs, have not been adequately assessed by the government. This is an experiment that cannot be justified.”“Regrettably, there is often a rift between what is legal and what is right. We will pursue all legal means to stop this project. It is our hope, however, that all people of conscience will contact their political representatives to encourage them to do what is right.” Shanker also stated. “Snowbowl is not a destination ski area. People do not travel from across the Country and around the world to ski at Snowbowl.&lt;br /&gt;&lt;br /&gt;Indeed, many of the press reports on this issue have overstated the economic contribution that Snowbowl makes to the Flagstaff economy -- which is marginal. People do, however, travel from around the world to the Flagstaff region to experience the ways of, especially the Navajo and Hopi Tribes. Other than to preserve the economic viability of a private entity, there is no adequate justification for this project.”“As this nation prepares to celebrate the legacy of Dr. Martin Luther King Jr. and the struggle for Civil rights, how can we as native people celebrate when our civil rights, our human rights are being profaned, are being violated?” Said Jeneda Benally, member of the Save the Peaks Coalition, “The Civil rights movement went to court fighting for their rights and had many wins and losses. This ruling shows that in this day and age there is still injustice in the legal system. We will continue with our prayers, we will continue to oppose the ongoing attempts to violate human rights. The sacred mountain supports life, so we are strong, and we will continue to defend the sacred San Francisco Peaks. Owner Hilly Kristal is searching for a new location with the help of the mayor's office. Turning the clocks back three decades to the dawn of punk, the New York Dolls made up for the tacky, overpriced art at this year's Art Basel Miami Beach by blowing away the sands at Collins Park. Skeptics figured that a band with only two of the remaining members would be a shadow of its former self. But David Johansen and Sylvain Sylvain honored their deceased collaborators by being everything other aging rockers with big- mouthed singers are not: sexy, sloppy-tight, relevant, generous, provocative. They even still write good songs.&lt;br /&gt;&lt;br /&gt;Johansen must have been joking when he introduced a mournful ode to song and beauty by saying they'd written it that day, it was just too perfect to be that fresh. The singer looked un-fucking-believably gorgeous. His Buster Poindexter persona must have been the aging Dorian Gray portrait he showed to the public, while the real Johansen, the New York Doll, was preserved in a pickle jar somewhere. How does a 55-year-old stay that skinny and have such good hair? And have such a great sense of style, that funky but chic, semi-drag trash look the Dolls invented back when culture wasn't so binary about boy/girl. Sylvain put his all into his playing, as if he'd been waiting three decades for just this moment. "Let's do a song for Johnny Thunders,'' he said, then sang and strummed "You Can't Put Your Arms Around a Memory.'' A lawsuit has been filed by the Navajo Nation, Hopi Tribe, Havasupai, Hualapai, White Mountain Apache, Yavapai Apache, Sierra Club, Flagstaff Activist Network, Southwest Center for Biological Diversity, Dine’ Medicine Men’s Association &amp; a Hopi traditionalist against the United States Forest Service due to its attempt to allow the Arizona Snowbowl Ski area expansion, which includes; clear cutting 74 acres of rare alpine ecosystem, building a 14.8 mile buried pipeline, and snowmaking from wastewater on the sacred mountain.&lt;br /&gt;&lt;br /&gt;On October, 12th, 14th, 17th, &amp;amp; 18th, the &lt;em&gt;Religious Freedom and Restoration Act&lt;/em&gt; will be the focus of the trial at the Federal Courthouse in Prescott, AZ. Prayers of all faiths and denominations are needed to support the tribe’s and environmental group’s lawsuit and to ensure that Judge Paul Rosenblatt will make a ruling that upholds religious freedom and human rights. The court will be in session from 9:00 am to 5:00 p.m. Mountain Standard Time. On Sept. 15, The Ramones Museum Berlin - billed as the world's first Ramones museum - opened to the public. A project of a die-hard German fan, Florian Hayler, it houses more than 300 photographs, records, news clippings and other memorabilia. That includes an unwashed pair of jeans owned by the guitarist Johnny Ramone, the drummer Marky Ramone's sneakers and an autographed black leather jacket.&lt;br /&gt;&lt;br /&gt;The museum had the blessing of the living members of the group, Marky and C. J. Ramone, Mr. Hayler said. Marky Ramone, speaking from his home in Brooklyn, said, "I'm very flattered that another country will help keep the Ramones legacy alive."&lt;br /&gt;&lt;br /&gt;Dee Dee Ramone, the songwriter and bassist who died in 2002, spent much of his childhood in Berlin, a connection made evident by Ramones songs like "Born to Die in Berlin" and "It's a Long Way Back to Germany." Referring to the deceased band members Joey, Johnny, and Dee Dee, Marky Ramone said: "Knowing them, they would have been flattered, because they worked very hard. Luckily, they saw most of the punk bands naming the Ramones as an influence. At least they saw that."&lt;br /&gt;&lt;br /&gt;Admission to the Ramones Museum is free. "It's a museum for fans, by fans," said Mr. Hayler, 32, whose personal collection, which includes 170 Ramones T-shirts, supplied most of the museum's holdings. Mr. Hayler, who said he attended 101 Ramones concerts, opened the museum because "I didn't have any more space at home."&lt;br /&gt;&lt;br /&gt;Traces of vintage New York are everywhere in the museum - issues of the magazine New York Rocker, now defunct, and photographs of the Ramones on the subway and posing on the Bowery near CBGB. "The first time I went to New York, I took a cab to CBGB's at 6 a.m. and waited in front of it until it opened," Mr. Hayler said. The New York-based sociologist Donna Gaines, who has crusaded to keep CBGB open, said: "We need an American Ramones Museum.
